We will endeavour to ensure that the Save & Invest website is available 24 hours per day without any interruptions. However, we reserve the right to make the Save & Invest website unavailable at any time or to restrict access to parts or all of the Save & Invest website without notice. The Save & Invest website is a general information service. We will endeavour not to make it misleading, but we cannot represent that the information accessible on or via the Save & Invest website is accurate, not-misleading, complete or up to date.

Once you have accessed the Online Service, you will be deemed to have accepted these Online Terms and these Online Terms will form a legally binding agreement. Save & Invest grants you the right to use the Online Service and your User Name, Password & PIN, solely for use in accordance with these Online Terms and any other instruction or direction for use supplied to you by Save & Invest from time to time via the Online Service or otherwise. You agree to comply with these Online Terms and any such other instruction or direction. Your right to use the Online Service is personal to you and you may not permit any other person to gain access to the Online Service using your User Name, Password & PIN.
Technological changes from time to time may make the equipment which you use to access the Online Service (the "Equipment") obsolete or otherwise unsuitable. You are solely responsible for providing, updating, or replacing any part of the Equipment and for any telecommunication and other related costs. Save & Invest makes no warranty as to the suitability or otherwise of the Equipment, which is your responsibility alone. Save & Invest reserves the right to change the Online Service at any time even if this causes you the need to update or replace the Equipment.
You consent to the processing by Save & Invest, by associated and affiliated companies and by any third parties involved in the provision to you of products or services of the personal data submitted by you through the Online Service and/or created in the course of your relationship with Save & Invest and to the transmission of such personal data to such associated and affiliated companies and/or third parties for purposes connected with customer administration.
At its sole discretion Save & Invest may bar the use of your User Name, Password & PIN from time to time due to security or other concerns or for general administration purposes. Save & Invest will inform you as soon as reasonably possible of such action. You may then request a new User Name, Password & PIN by telephoning Save & Invest on (+44) 0800 132 740.
You must take all reasonable steps to keep your User Name, Password & PIN secret. You must not write it on anything Save & Invest sends you about your account or anything usually kept with them. If you do write it down anywhere, you must disguise it so that nobody will know it as your User Name, Password & PIN.
If you become aware of, or suspect any unlawful or unauthorised use of your User Name, Password & PIN you should immediately change the Password and/or PIN using the facility provided by the Online Service. You should bring this to Save & Invest's attention by telephoning Save & Invest on (+44) 0800 132 740 as soon as possible.
You will be treated as authorising Save & Invest to act on dealing instructions sent through the Electronic Dealing Facility without further written confirmation to Save & Invest. Online instructions can only be given in English. Such instructions will be treated as your instructions if they were given using your User Name, Password & PIN and provided that Save & Invest or its employees were not guilty of negligence, fraud or wilful default. This authorisation remains in force until Save & Invest receives notice from you of its termination (given in writing or by means of the Online Service). Such notice will not affect the completion of transactions already initiated by Save & Invest pursuant to this authority or by you with any third party via the Electronic Dealing Facility.
Save & Invest reserves the right to obtain from you written confirmation of any instruction sent through the Electronic Dealing Facility.
When Save & Invest accepts your instructions, Save & Invest will send you a reference number and an electronic confirmation of your Order. Where available you will also receive electronic statements and valuations through your Electronic Dealing Facility. Save & Invest will keep a record of all transactions, which is available on request. Save & Invest accepts no liability for failure to carry out any Electronic Order which you place using the Electronic Dealing Facility unless you can show that you have received a reference number and an accurate confirmation of such Electronic Order, nor if Save & Invest is unable to obtain authorisation on your debit or credit card for payment of the full amount due or if incorrect details are submitted with your instruction. You will notify Save & Invest as soon as possible if you do not receive a reference number and confirmation immediately after placing an Electronic Order.

If you fail to notify Save & Invest as soon as possible in any of these circumstances, you will be deemed to have accepted the Online Terms of the Electronic Order as stated on the confirmation provided to you by Save & Invest.
You understand and agree that telephone calls to Save & Invest may be recorded and monitored. You understand that all other Online Terms and Conditions, (including Save & Invest's Terms and the Terms of business of any third party involved in the provision to you of products or Services), applications completed or otherwise accepted by you as well as any applicable instruments, deeds, prospectuses and scheme particulars control the operation of your Save & Invest accounts and that the Online Service is provided subject to all those matters. In the event of a conflict between these Online Terms and those other matters, these Online Terms shall prevail in respect of details specifically concerning use of the Online Service, unless expressly provided otherwise.
You may if you wish record the existence and value of any other assets held by you (but not advised on by S&I) on our system in order to provide you with as complete a record in one place of all your assets and their value. However, the responsibility for keeping this data up to date and the valuations accurate rests solely with you. S&I will not accept any liability for any inaccuracies or incompleteness in this data.
Save & Invest owns the copyright and any other intellectual property rights subsisting anywhere in the world relating to the Information, the databases and your User Name, Password & PIN. You have no rights to the User Name, Password & PIN and Information other than as set out in these Online Terms. If you become aware of or suspect any unlawful or unauthorised use of the Online Service (or if you become aware of or suspect any other infringement by any person of rights of Save & Invest in the Information) you must bring this to the attention of Save & Invest immediately and give Save & Invest any details you have in relation to this.
You may not copy, reproduce, duplicate, modify, adopt or lend, sell or otherwise transfer, in whole or in part, any of the Information, except for the purpose of accessing the Online Service and producing print-outs for your own personal use. Your rights under these Online Terms are personal to you and you may not sub-license, assign or otherwise transfer any of those rights. You must not allow anyone else to use your User Name, Password & PIN.
Save & Invest makes no warranty or representation that the Online Service can be accessed at all times. The Online Service may be temporarily unavailable or restricted for administrative or other reasons and Save & Invest does not accept any responsibility and will not be liable for any loss or damage arising out of or in connection with loss of use of the Online Service.
You acknowledge that your uninterrupted access to the Online Service and use of the Electronic Dealing Facility may also be prevented by certain factors outside the reasonable control of Save & Invest (a "Service Disruption Event") including, without limitation, the in-operation, inefficiency or unsuitability of the Equipment and the unavailability, in-operation or interruption of Internet or other telecommunication services. Non-performance by Save & Invest of its obligations under these Online Terms will not be a breach of these Online Terms where such non-performance results directly or indirectly from a Service Disruption Event. Save & Invest does not accept any responsibility and will not be liable for any loss or damage arising out of or in connection with any such Service Disruption Event.
Save & Invest does not accept any responsibility and will not be liable for the inaccuracy or incompleteness of any information received by you or by Save & Invest through the Online Service which arises out of or in connection with data transmission, machine or software error or malfunction or from your operating error or which originates from information obtained from third parties (other than such inaccuracy or incompleteness arising as a result of Save & Invest's negligence, fraud or wilful default). Save & Invest does not accept any responsibility and will not be liable for the performance of any third party involved in the provision to you of products or services, regardless of whether you have made contact with such third party via the Online Service. You agree that Save & Invest has a lien over such of your cash and investments (including units or shares in any collective investment scheme) as are held by Save & Invest or under Save & Invest's control to the extent of any costs, claims or other liabilities suffered or incurred by Save & Invest and arising as a result of your failure to comply with the Online Terms and conditions agreed between you and Save & Invest and/or between you and any such third party, and that Save & Invest may accordingly realise without notice sufficient of your cash and investments to meet any such costs, claims or other liabilities.
Save & Invest reserves the right to change any third party who provides products or Online Services to you via the Online Service. You authorise Save & Invest to notify such other parties as it may deem necessary or desirable if any such third party provider is changed.
A failure or delay by either party to enforce any right under these Online Terms is not an implied waiver of the same or of any other right in the future.
All of the Online Terms and conditions relating to the Online Service are contained in these Online Terms and any other instruction or direction for use supplied by Save & Invest to you via the Online Service or otherwise. Oral communications that you have with Save & Invest shall not become part of the Online Terms relating to the use of the User Name, Password & PIN, the Information or the Online Service unless Save & Invest confirms them to you in writing or by means of the Online Service.
If any provision in these Online Terms is held or made invalid by a court, statute, rule or otherwise, the remainder of these Online Terms will not be affected.
These Online Terms shall be governed by and construed in accordance with the laws of Scotland.
The Courts of Scotland will have exclusive jurisdiction to settle any claim or matter arising under or in relation to these Online Terms.
You agree to only use the Save & Invest website for lawful purposes and that any information that you provide in connection with, or which forms part of, the Save & Invest website will be, as far as you are aware, true and accurate and will not infringe any copyright or trade mark, or any right of privacy, publicity or personality or any other right, whether registered or unregistered, of any other nature or any person, or be obscene or libellous or blasphemous or defamatory and you agree to indemnify us against all claims, proceedings, damages, liabilities and costs, including legal costs arising out of your breach of this term. We cannot make any assurances about the information or contribution made by any other user and you should exercise caution before acting or otherwise relying upon any information you obtain via the Save & Invest website.

Since a substantial part of the Save & Invest website is both free and available to all, it is a condition that your use of the Save & Invest website is at your own risk. We shall not be liable to you or in breach of this User Agreement for any delay or failure to perform any obligation if the delay or failure is due to a cause beyond our reasonable control including, without limitation, the blocking or restricting of information to and/or from our network. Except as expressly provided in this User Agreement, we disclaim any further representations, warranties, conditions or other terms, express or implied, by statute, collaterally or otherwise, including but not limited to implied warranties, conditions or other terms of satisfactory quality, fitness for a particular purpose or reasonable care and skill. Either of us may terminate this User Agreement at any time. You may not transfer any of your rights or delegate any of your obligations under this User Agreement without our prior written consent. If we fail to enforce any provision of this User Agreement, that failure will not preclude us from enforcing either that provision (or any similar provision) on a later occasion. Nothing in this User Agreement shall confer on any third party any benefit or the right to enforce any term of the User Agreement. This User Agreement is governed by Scots law and any dispute connected with this agreement is subject to the exclusive jurisdiction of the Scottish courts.
